Terms and conditions

The rules for using Kambak: plans, billing, notifications, data and the parts store.

Draft — pending legal review. This translation is provided for convenience; the binding version is the Spanish one (Argentina). Read the Spanish version. This text may change before launch. Last updated: October 10, 2026.

1. Parties and acceptance

These terms govern the use of Kambak (the “Service”), provided by Javier Bagdadi, domiciled at Av. del Libertador 6199, CABA (C1428), Argentina (“Kambak”). By creating an account, the business or the person representing it (the “Business”) accepts these terms and the privacy policy. Whoever accepts declares that they are of legal age and have the authority to bind the Business.

The Business’s customers who add a card to their wallet (“End customers”) use the Service free of charge; their relationship is with the Business, which is responsible for the promotions, rewards and benefits it offers.

2. The service

Kambak makes it possible to create digital stamp, points, membership, coupon and gift cards for Google Wallet and Apple Wallet; distribute them via QR and NFC; record visits and redemptions; send notifications; collect membership fees through Mercado Pago on behalf of the Business; view statistics and use artificial intelligence features. The available features depend on the plan purchased.

Google Wallet and Apple Wallet are third-party services. Kambak does not control their changes, limits (for example, Google allows up to 3 notifications per pass per day) or outages, and may adapt the Service to their rules.

3. Account

  • The Business must provide real information and keep it up to date.
  • It is responsible for the actions of its users (owners and staff) and for keeping their credentials confidential.
  • It must notify us immediately if it detects unauthorized access.

4. Plans, trial and prices

  • There is a Free plan and paid plans (Starter, Pro and Multi-location) with the limits published at kambak.app/en#precios. Prices in Argentine pesos, VAT included.
  • Every new account uses the Pro plan for 14 days free of charge and without requiring a payment method. When the trial ends, if the Business has not chosen a paid plan, it moves to the Free plan and its limits apply.
  • Plans are paid in advance, monthly or yearly (the yearly plan is equivalent to 10 months), through a Mercado Pago subscription with automatic debit and retries.
  • Prices may be adjusted every 3 months according to the Consumer Price Index (IPC) published by INDEC, with at least 30 days’ notice by email. If the Business does not agree, it may cancel before the new price takes effect.
  • If a charge fails and is not resolved after the retries, the account moves to the Free plan; the data is kept.

5. Cancellation, termination and withdrawal

  • No minimum term. The Business may cancel at any time from the dashboard or with the cancellation button, without logging in. Kambak provides the request code within 24 hours and, so that no one can cancel someone else’s account, sends a confirmation link to the account’s email (a single click, without logging in). The plan remains active until the end of the period already paid and is not renewed.
  • Withdrawal. As a distance contract, a Business that is a consumer under Law 24,240 may revoke its acceptance within 10 calendar days from the purchase (section 34 of Law 24,240 and section 1110 of the Civil and Commercial Code), at no cost and without liability, using the withdrawal button. The amount paid is refunded through the same payment method.
  • These buttons follow Provision 954/2025 of the Undersecretariat of Consumer Protection and Fair Trade (which replaced Resolutions 316/2018 and 424/2020) and Provision 3/2026 (identity validation), and are available in the footer of every public page.

6. Notifications and acceptable use

Each plan has a monthly cap on campaigns (1 on Free, 4 on Starter and 12 on Pro), in addition to automations, to protect the experience of End customers and the issuer account shared by all businesses. Before each send, notifications go through an automatic review. The Business agrees not to use the Service to:

  • send spam, or misleading, illegal or offensive content, or content that infringes third-party rights;
  • send promotions to people who did not accept them, or sensitive data through notifications;
  • include links to malicious sites or sites unrelated to its business;
  • attempt to access other businesses’ data or breach the security of the Service;
  • fraudulently simulate visits or stamps.

Kambak may stop a send, or suspend features or the account in the event of a serious breach, notifying the Business and giving it the opportunity to explain itself, except in urgent cases.

7. End customers’ data

  • The Business is the data controller of its End customers’ database and Kambak acts as data processor (section 25, Law 25,326): it processes the data only to provide the Service, following the Business’s instructions, with security measures, and does not use it for its own purposes.
  • The Business guarantees that it informs its customers and obtains the necessary consents (for example, for promotions), and that it registers its database with the AAIP when applicable.
  • When the contract ends, Kambak delivers the data to the Business if requested and deletes it within 90 days, unless there is a legal obligation to keep it.
  • Kambak uses providers (hosting, Google, Apple, Mercado Pago, artificial intelligence, email) that may be located outside the country, as described in the privacy policy.

8. Collection of membership fees on behalf of the Business

When the Business connects its Mercado Pago account, its End customers’ fees are charged in its name and credited to its account. The Business is the seller towards its customers and is responsible for what it offers, for invoicing and for claims and refunds. Kambak is not a party to that transaction.

9. Parts store

  • Part prices are final, VAT included; shipping is shown before payment.
  • Parts are made to order with the Business’s logo and shipped by mail.
  • There are 10 calendar days from delivery to withdraw from the purchase, using the withdrawal button.
  • 6-month warranty against manufacturing defects (section 11, Law 24,240).

10. Artificial intelligence

AI-generated suggestions (texts, designs, segments, campaigns) are proposals: the Business reviews them and decides whether to use them. Kambak does not guarantee commercial results.

11. Intellectual property

The software, the Kambak brand and its designs belong to Kambak. The Business retains the rights to its brand, logo and content, and authorizes Kambak to use them only to provide the Service (for example, to display them on the passes). On the Free plan, passes display the legend “Hecho con Kambak” (“Made with Kambak”).

12. Availability and liability

We do what is reasonable for the Service to work continuously and securely, but there may be interruptions due to maintenance, third-party failures (Google, Apple, Mercado Pago, cloud providers) or causes beyond our control. To the extent permitted by law, Kambak’s liability towards the Business is limited to the amount paid by the Business in the 12 months prior to the event. Nothing in this limits consumers’ non-waivable rights.

13. Changes to these terms

We may update these terms. Material changes are notified by email at least 30 days in advance; if the Business does not agree, it may cancel at no cost before they take effect.

14. Governing law and contact

These terms are governed by the laws of the Argentine Republic. Any dispute shall be submitted to the ordinary courts of the Autonomous City of Buenos Aires, without prejudice to the consumer’s right to choose the courts of their domicile. Questions and complaints: jabagdadi@gmail.com or WhatsApp +54 11 3602-0034.
